GENERAL TERMS AND CONDITIONS

1. Scope and consent

The following General Terms and Conditions (hereinafter referred to as “GTC”) of Merz AG, Wildegg (hereinafter referred to as ‘Seller’) form the basis of the contract for all goods and services offered via our website www.cat-footwear.ch (hereinafter referred to as “Webshop”). Goods and services may only be ordered by persons with legal capacity, i.e. persons who are capable of forming a valid legal agreement and who are of legal age (hereinafter referred to as “Customers”). By ordering goods or services, the Customer accepts these GTC as valid and binding. Any deviating terms and conditions must be agreed in writing (email is considered sufficient written form).
By submitting an order via the Webshop, the Customer confirms that they have read these GTC and expressly agree to them. The GTC are thus binding.

2. Conclusion of contract

All information about goods and prices in the Webshop does not constitute a legally binding offer; we reserve the right to make changes to the design, availability, or price.
By submitting the order via the web shop, the customer places a binding order. The customer will receive an automated order confirmation from the seller immediately after receipt of the order. This does not yet constitute acceptance of the contract by the seller. The purchase contract is concluded when the order confirmation is sent by email or when the goods are delivered by the seller. If a product is not available in the type or quantity ordered or if the price has changed in the meantime, the customer will be notified by the seller. By confirming any changes or an alternative offer communicated by the seller, the customer can confirm the order accordingly. If there are any questions regarding the offers, the customer can contact the seller (office@merznet.ch).

3. Delivery
Ordered items will generally be shipped within 2-3 working days, depending on availability. If an item cannot be delivered immediately, the seller will notify the customer by email or telephone. Goods are generally shipped via Swiss Post. The customer is responsible for ensuring that the delivery address is correct. If Swiss Post or the shipping company cannot find the correct address or delivery is not possible (e.g. because the address is incomplete or incorrect, or because delivery to a PO box is not possible), the customer shall bear the return costs charged by Swiss Post.
Delivery can generally only be made within Switzerland and the Principality of Liechtenstein.

3.1 Liability for the shipment of packages

The seller is liable for the proper packaging and handover of the goods to Swiss Post or another delivery service commissioned by us. Upon handover of the package to Swiss Post, liability for damage or loss of the goods passes to Swiss Post or the buyer. From the moment the package is delivered to the specified address or to an agreed secure location, responsibility for the package lies with the customer. The seller is not liable for the loss or damage of the package.

4. Prices & shipping costs

All prices stated in the online shop include the value added tax required by Swiss law (currently 8.1%) and exclude shipping costs. The transport costs are borne by the customer. The estimated shipping costs are displayed to the customer in the shopping cart when the order is completed. Standard shipping (approx. 3-4 days) is free of charge for purchases of CHF 49.00 or more. If higher shipping costs are actually incurred, the customer will be charged the actual shipping costs incurred. Shipping costs are calculated at the time of shipment. The shipping costs are determined according to the current price list of Swiss Post (https://www.post.ch/).

5. Payment

5.1 Payment options
The customer has the following payment options: Credit card (Visa, Mastercard), TWINT, and instant transfer (Klarna). When paying by credit card or other instant payment methods, the amount will be charged at the time of the order. When purchasing on account, the customer must settle the claim within 14 days of the invoice date. If the seller does not receive payment on time, a reminder will be sent. In the event of persistent non-payment without consultation with the buyer, the seller will initiate debt collection proceedings.

5.2 Information on transaction fees
When processing payments via payment service providers outside Switzerland, additional fees may apply depending on the credit card provider (approx. +1.2%). For more detailed information, please contact your bank.

6. Returns and right of withdrawal

The customer has the right to return or exchange the goods received within 14 days of receipt (the date of the postmark is decisive). Returns can be initiated using the return form.
The items must be returned unused, undamaged, and in their original packaging, otherwise the right to exchange or return the goods will be forfeited. A refund for returned goods will be made after the seller has received them in good order. The seller reserves the right not to refund the value of goods that have not been returned properly.
The shipping costs for returning items are borne by the customer, unless the customer has been delivered incorrect or defective goods. In this case, the seller shall bear the return shipping costs. If the purchase was made by credit card, the refund will be made to the card used. If the invoice has already been paid, the refund will be made to the payment account within 10 working days.


7. Reporting defective goods and warranty

The statutory warranty periods apply. The customer must check the goods immediately upon receipt for correctness, completeness, and functionality. Goods that have been shipped and show obvious material or manufacturing defects must be reported to the seller in writing (office@merzent.ch) immediately upon receipt and (unless otherwise agreed with the seller) returned to the seller immediately.
Warranty is excluded in the event of improper use or natural wear and tear. Any transport damage must be reported directly to the transport company. Please note the return policy.

8. Liability
Liability is excluded to the fullest extent permitted by law. The seller shall not be liable for any direct, indirect, or consequential damages incurred by the customer through or in connection with the order or use of the goods.

9. Data protection
The relevant data protection declaration applies to the processing of personal data by the seller.

10. Changes to the GTC
The seller expressly reserves the right to change the GTC published here at any time without prior notice. The GTC published in the web shop at the time of the order apply.


11. Choice of law / place of jurisdiction
Swiss law applies exclusively. The place of jurisdiction is Lenzburg AG. The application of the provisions of the Vienna Sales Convention (“United Nations Convention on Contracts for the International Sale of Goods”) is expressly excluded.
